TERMS & CONDITIONS 

These Terms and Conditions of Use ("Agreement" or "Terms") govern use of the Site (the "Site") and any related digital platforms operated under Kat Rhea Real Estate Services, LLC (“KRRES,” "we," "us," or "the"). By accessing the Site or engaging with the Services, you agree to these Terms. If you do not agree, you must discontinue use of this Site and services immediately.

1. GENERAL INFORMATION

Kat Rhea Real Estate Services, LLC is a licensed real estate company providing real estate services including related sales, marketing, investment and management. KRRES assumes no liability for sales or site operations, e.g., product transactions, disputes, or data security.

By using this Site, you acknowledge that all purchases, refunds, disputes, and transactional matters should be addressed directly with us using the contact information provided in Section 17.

We may update these Terms at any time. Continued use of the Site after updates constitutes acceptance of the revised Terms.

We have no ownership, financial interest, or controlling stake in other real estate services.

2. USE OF THE SERVICES

Site users have a limited, revocable, non-transferable, and non-exclusive license to access the Site for personal, non-commercial purposes. Users may not:

  • Copy, modify, distribute, or exploit any part of the Site for commercial purposes.

  • Interfere with Site functionality or security.

  • Use automation tools to scrape, extract, or collect data.

  • Use the Site to engage in unlawful or fraudulent activity.

  • Misrepresent their identity when using the Site.

Violation of these Terms may result in suspension or termination of access.

3. USER ACCOUNTS & COMMUNICATIONS

To access certain features, users may need to create an account when desired. By creating an account, you:

  • Agree to provide accurate, updated information.

  • Accept responsibility for maintaining account security.

  • Agree to receive marketing and promotional communications (you may opt out at any time).

  • Acknowledge that we do not process payments, determine product descriptions, program site functionality or store customer financial information other than that necessary for our operations and at our discretion.

4. TRANSACTIONS & PAYMENTS

All purchases, real estate activities, order processing, and payment transactions are managed by us as the Merchant or Record or licensed real estate broker. We do not unless by prior agreement and where applicable:

  • Process or manage customer payments.

  • Store or retain financial data.

  • Issue refunds or handle disputes.

  • Guarantee product availability, pricing, shipping or fulfillment.

5. RETURNS & REFUNDS

All return and refund policies, when any products are involved, are governed by our terms and conditions. We does not process returns or issue refunds except by mutual agreement.

6. DISCLAIMER OF LIABILITY

Kat Rhea Real Estate Services, LLC (“we,” “us,” or “our”) does not oversee, verify, or guarantee the security, accuracy, reliability, or performance of any third-party vendors, platforms, or service providers unless expressly agreed to in writing. Use of this Site and any services or information provided is at your own risk.

To the fullest extent permitted by law, we expressly disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, title, and non-infringement. We make no representations or guarantees regarding:

  • Product quality, condition, accuracy, or functionality;

  • Shipment timing, order fulfillment, or non-delivery of items;

  • Property purchase satisfaction;

  • Customer service matters, including refunds, inquiries, or complaints;

  • The security or privacy of financial transactions;

  • Data breaches, cybersecurity incidents, or technological malfunctions affecting Site availability or use;

We are not liable for any indirect, incidental, consequential, exemplary, or punitive damages—including, without limitation, loss of profits, data, goodwill, or business interruption—arising from your use of or inability to use the Site, services, or any associated third-party platforms.

By using this Site, you agree to release, indemnify, and hold harmless Kat Rhea Real Estate Services, LLC, including its owners, directors, officers, employees, agents, contractors, representatives, affiliates, successors, and assigns from any and all claims, disputes, losses, or liabilities, whether known or unknown, resulting from or related to your use of the Site, services, or third-party vendors.

This limitation of liability survives termination of your use of the Site.

By using the Site, you release and hold us, our owners, agents, employees, representatives, contractors, subcontractors, affiliates, officers, directors, consultants, volunteers, successors and assigns harmless from any claims, disputes, or damages related to transactions or losses caused by any third-party vendors or agents.

All content on this Site, including text, images, and trademarks, exclusive and separate from our branding, images, text and trademarks and copyright material, are our property and users may not:

Acceptance of Terms and Indemnification

  • Any misuse or unauthorized use of this Site, including fraudulent activity, security breaches, or violations of these Terms,

  • Any disputes or liabilities arising from payments, contracts, product quality, warranties, cybersecurity incidents, or any transaction-related issue occurring through or as a result of your interactions with this Site, third-party vendors or our organization.

Your continued use of the Site constitutes ongoing agreement with these Terms, including your obligation to hold us harmless from any claims resulting from third-party actions or your own misuse of the Site or our services.

This indemnification obligation applies to all claims, whether direct or indirect, and will survive the termination of these Terms and the use of the Site.

10. DISPUTE RESOLUTION & ARBITRATION

All disputes related to purchases, refunds, or transactions must be directed to us and does not imply any agreement, acceptance or medication concerning a perceived or stated dispute involving any product, sale or transaction.

For disputes arising specifically from Site use (excluding transactions) legally determined to involve us, users agree to:

  • First attempt to resolve disputes informally by contacting support.

  • Submit to binding arbitration in the event of unresolved disputes, under the laws of the State of Louisiana.

  • Waive the right to participate in class actions.

Users waive the right to bring any claims against us related to third-party transactions, and any legal claims, if necessary, shall be exclusively limited to direct disputes regarding the use of the Site involving us in any consulting, sales or marketing capacity, excluding e-commerce activities.

11. GOVERNING LAW

These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles, except where superseded by applicable federal or international laws.

12. UPDATES & CHANGES

We reserve the right to update these Terms at any time. Users are responsible for reviewing changes periodically.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of the Site, services, or real estate transactions, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow limitations on implied warranties or limitation of liability for certain damages, some of the above disclaimers may not apply. In such cases, liability is limited to the fullest extent permitted by law.

14. NO PROFESSIONAL OR INVESTMENT ADVICE

15. CLIENT RELATIONSHIPS & LICENSE DISCLOSURE

Use of this Site does not establish a brokerage or agency relationship unless and until a written agreement is signed by both parties. We operate under applicable state real estate licensing laws and is governed by the Louisiana Real Estate Commission.

Clients seeking representation in real estate transactions must enter into a formal client agreement consistent with state laws and professional standards.

16. SITE AVAILABILITY & TECHNOLOGY DISCLAIMERS

We make no guarantees as to the continuous availability, functionality, or performance of this Site. The Site may be temporarily unavailable for maintenance or due to technical issues beyond our control.

We are not responsible for any loss or damage resulting from interruptions, delays, cyberattacks, viruses, or other security vulnerabilities that may affect your access or use of the Site.
